In legal terms, they have no legal capacity [...]"For the copyright protectability of AI-generated data and content, it is decisive whether and to what extent they are attributable to the creative activity of a human being. Copyright is a personal property right. Source: irigths.infoIn other words: you own the generated ai art, if you edit the output. This is a huge problem in the art community. Even if the generated image is similar to the original, it is still an independent work to which the creator has the rights (on the other hand: if it is clearly visible that is has been copied, you still can get a law strike - it depends on the individual case). Morally speaking, it is theft, but no legal action can be taken against it (as for now). If you actually consider of using ai to generate artworks, please keep in mind that another artist put a lot of effort into the original artwork and is loosing a "ton hell shit" of money. If you have a conscience NEVER use ai art for commissions.

══ ⊹⊱≼ Tracing? ≽⊰⊹ ══Tracing is when you copy the lines of another work of art one to one. Tracing is good as long as it is only used for training purposes. In this case, please always credit the original artist! This also applies to fanart. Tracing is also fine as long as you implement it with your own references (for example: you photograph a rose and trace it). Tracing is theft, however, if you intend to earn money with it. In this case, the original artist can also report you for the theft of intellectual property and demand compensation. Don't be dumb, trace and try to sell this "artwork".

══ ⊹⊱≼ Commissions? ≽⊰⊹ ══If you want to make your own commissions, you need at least these information (esp. for your taxes!):Name, contact options, date, description of the work, price,
contract conditions (!!!)Make a note, that your receipt/acknowledment/contract is valid without signature. Especially the contract conditions are important. They protect you as the artist, if any problems occur (f.e.: the customer wants a refund or is unsatisfied with the product). In case of german law, you also need an imprint with your adress. There are possibilites to keep your private adress anonymous with the help of using legal systems like autorenglück or postflex. This is a good way to keep your privacy save.

══ ⊹⊱≼ Copyright Law? ≽⊰⊹ ══The following information are based on the german legal system, but might be useful information for you anyway. In any case: if things are unclear, always contact your lawyer or tax consultant. These information dont replace legal advice!The Copyright gives the creator the exclusive and fundamental right to use the work. It is the subjective and absolute right to the protection of intellectual property in both non material and material terms. It is not possible to transfer the copyright to others, but you can transfer the rights of use to third parties. As the creator/author you decide in which manner the buyer/client/owner can use your work, however you have to be very clear with your wording so there won't be any missunderstandings and no loopholes in the contract. It can be determined that the use by the author remains reserved.For example:
Easy usage: You are selling ready-to-use emotes at a store (like Etsy, Ko-Fi etc.) - Exclusive usage: You are working on a commission for a person like a fullbody drawing of this person's own characterIf you want to sell your work, please keep always in head the following side notes: who is allowed to use your work? To what extent is the buyer/client/owner allowed to use your work? Does the buyer/client/owner get simple or exclusive rights to use your work what are the limitations of using your work? As soon as it comes to money, justify your compensation like your working hours, material usage, complexity etc. Never sell below value! You are a great artist and there is no reason to sell below value!
